Child support ensures children are financially supported after separation. Getting the arrangement right can be complex where income structures, self-employment, private schooling or extra expenses are involved.
We advise on child support assessments, private child support agreements, departures from administrative assessments, and disputes involving Services Australia.
Our approach focuses on practical solutions that support the long-term needs of children while giving both parents clarity and certainty.
How we can help
- Binding and Limited Child Support Agreements
- Private school fees and extra expenses
- Change of assessment (departure) applications
- Self-employed and trust-structured incomes
- Objections and reviews with Services Australia
How the process works
- 1
Review the assessment
We check how the formula has been applied to your incomes and care arrangements.
- 2
Identify the right path
An agreement, a change of assessment or a Court application may suit your situation better than the default formula.
- 3
Document it properly
Child support agreements have strict legal requirements. We draft them so they are valid and enforceable.
- 4
Resolve disputes
We act in objections, reviews and Court departure applications when agreement cannot be reached.
Common questions
How is child support calculated?
Services Australia applies a formula based on both parents' incomes, the number and ages of the children, and the level of care each parent provides.
Can we agree on our own arrangement?
Yes. Parents can enter a Limited or Binding Child Support Agreement. A Binding agreement requires each parent to receive independent legal advice.
What if the other parent's income looks artificially low?
A change of assessment application can address income that does not reflect true earning capacity or financial resources, for example where income flows through a company or trust.
